Welcome to Swoopster ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our platform, including our website, mobile application, and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, accessing, or using the Swoopster platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Service.
2. Description of Service
Swoopster is a marketplace platform that connects customers seeking cleaning services with independent cleaning professionals ("Cleaners") in Ghana. We facilitate bookings, payments, and communication between customers and Cleaners. We are not a cleaning service provider and do not employ Cleaners.
3. User Accounts
3.1 Account Creation: To use certain features of our Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
3.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
3.3 Account Eligibility: You must be at least 18 years old to create an account and use our Service. By creating an account, you represent and warrant that you are at least 18 years old.
4. Service Fees
4.1 Platform Service Fee: Swoopster charges a service fee of 15% on all bookings made through the platform. This fee is deducted from the total booking amount before payment is processed to the Cleaner.
4.2 Payment Processing: All payments are processed securely through our payment partners. Customers agree to pay the total booking amount, including the platform service fee, at the time of booking confirmation.
4.3 Refunds: Refund policies are subject to the specific terms of each booking and may vary based on cancellation timing and circumstances. Please refer to our cancellation policy for detailed information.
5. Cleaner Responsibilities
5.1 Independent Contractors: Cleaners are independent contractors, not employees of Swoopster. Cleaners are responsible for their own taxes, insurance, and compliance with all applicable laws and regulations.
5.2 Service Quality: Cleaners agree to provide services in a professional manner, consistent with industry standards, and in accordance with the booking details agreed upon with the customer.
5.3 Background Checks: All Cleaners must undergo background checks and verification processes as required by Swoopster. Cleaners consent to these checks as part of the registration process.
6. Customer Responsibilities
6.1 Accurate Information: Customers must provide accurate information about their location, service requirements, and any special instructions or circumstances that may affect the cleaning service.
6.2 Safe Environment: Customers are responsible for ensuring a safe working environment for Cleaners. This includes disclosing any hazards, pets, or special conditions.
6.3 Payment: Customers agree to pay for services as agreed upon at the time of booking, including all applicable fees and taxes.
7. Cancellations and Refunds
7.1 Customer Cancellations: Customers may cancel bookings subject to our cancellation policy. Cancellation fees may apply based on the timing of the cancellation relative to the scheduled service date.
7.2 Cleaner Cancellations: If a Cleaner cancels a confirmed booking, we will work to find a replacement Cleaner or provide a full refund to the customer.
7.3 Refund Processing: Refunds, when applicable, will be processed to the original payment method within 5-10 business days.
8. Dispute Resolution
8.1 Dispute Process: If you have a dispute with another user (customer or Cleaner), we encourage you to contact us first. We will attempt to facilitate a resolution but are not obligated to do so.
8.2 Limitation of Liability: Swoopster acts as a marketplace platform and is not responsible for the actions, omissions, or conduct of users. Our liability is limited to the amount of fees we have collected from you in the 12 months preceding the claim.
9. Prohibited Conduct
You agree not to:
- Use the Service for any illegal or unauthorized purpose
- Violate any laws in your jurisdiction
- Infringe upon the rights of others
- Transmit any viruses, malware, or harmful code
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Service
- Harass, abuse, or harm other users
- Circumvent or attempt to circumvent our fees
10. Intellectual Property
The Service, including its original content, features, and functionality, is owned by Swoopster and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
11. Termination
11.1 By You: You may terminate your account at any time by contacting us or using the account deletion feature in your settings.
11.2 By Us: We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, with or without notice, for any reason, including violation of these Terms.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Ghana, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Ghana.
